Welcome to RaspiHost! By creating an account or using our BeamMP hosting services, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Service Description

RaspiHost provides BeamMP game server hosting services on a shared infrastructure. We offer both free and paid hosting plans as described on our website. All services are provided "as-is" and we reserve the right to modify, suspend, or discontinue any aspect of our services at any time.

2. Account Registration & Eligibility

• You must provide accurate information when creating your account
• You are responsible for maintaining the security of your account credentials
• You must be at least 13 years of age to use our services (or the minimum age required in your jurisdiction)
• Each user is permitted one account only. Creating multiple accounts to bypass limitations or obtain additional free servers is strictly prohibited and will result in termination of all accounts
• Account sharing is discouraged and you remain responsible for all activity on your account

3. Acceptable Use Policy

You agree to use RaspiHost services only for lawful purposes and in accordance with these Terms. The following are expressly prohibited:

3.1 Content Restrictions

• Hosting, storing, or distributing illegal content under United States law or the laws of California
• Hosting content that infringes on intellectual property rights, including pirated software or unauthorized game files
• Using our services for file storage, torrenting, mirrors, or any purpose other than BeamMP game server hosting
• Hosting malware, viruses, or any malicious code
• Hosting content that is obscene, defamatory, harassing, or threatening

3.2 Technical Restrictions

• Attempting to gain root access, escalate privileges, or bypass container security measures
• Deliberately attempting to crash, overload, or negatively impact server performance
• Cryptocurrency mining or any form of distributed computing not related to BeamMP
• Running automated attacks, port scanning, or network abuse
• Attempting to access other users' servers or data
• Reverse engineering, decompiling, or tampering with our infrastructure

3.3 General Conduct

• Spam, unsolicited advertising, or mass communications
• Fraudulent activity or payment abuse
• Violating the BeamMP End User License Agreement or terms of service
• Any activity that could damage RaspiHost's reputation or relationship with upstream providers

Violation of these policies may result in immediate suspension or termination without prior notice or refund.

4. Resource Usage & Fair Use

RaspiHost operates on shared infrastructure. To ensure quality service for all users:

• Sustained high usage may result in throttling, especially if impacting other users
• We may contact you if your server is using excessive resources and ask you to optimize or upgrade
• Free servers that remain inactive for extended periods (typically 30+ days) may be deleted to free up capacity for active users
• We will make reasonable efforts to announce planned free server purges via our Discord server
• You are responsible for ensuring your server software and configurations are optimized

5. Server Access & Data

5.1 Your Responsibilities

• You are solely responsible for all content hosted on your server
• You must maintain your own backups of important data
• You should regularly update and maintain your server software

5.2 Our Rights

• We reserve the right to access your server for administrative purposes, security reviews, or abuse investigations
• We may take backups of your data for disaster recovery purposes, but backups are not guaranteed
• We may inspect server content if we suspect Terms violations or receive abuse reports

6. Payments, Billing & Refunds

6.1 Payment Terms

• All prices are in USD and are subject to change with 30 days notice for existing customers
• Paid plans are billed monthly or quarterly in advance as selected
• Payment is currently accepted via PayPal only
• You are responsible for any taxes applicable in your jurisdiction
• All sales are final unless otherwise stated

6.2 Chargebacks & Disputes

• If you have billing issues or concerns, you must contact us before initiating a chargeback or payment dispute
• Chargebacks filed without prior contact will result in immediate and permanent termination of all services
• We reserve the right to pursue costs associated with fraudulent chargebacks
• Suspected payment fraud will result in immediate service suspension and potential legal action

6.3 Service Cancellation

• You may cancel paid services at any time through your account panel or by contacting us
• Cancellations take effect at the end of your current billing period
• No refunds will be provided for partial months or quarters unless required by law
• Free servers may be canceled by you at any time without notice

7. Uptime, Availability & Liability

7.1 Service Availability

• We do not guarantee any specific uptime percentage
• We strive for high availability but scheduled and unscheduled maintenance may occur
• We will make reasonable efforts to announce planned maintenance via Discord

7.2 Limitation of Liability

IMPORTANT: RaspiHost is provided as a hobby project. By using our services, you acknowledge:

• We are not liable for any data loss, corruption, or unavailability
• We are not responsible for any damages, losses, or costs arising from service interruptions
• We are not liable for any indirect, incidental, special, or consequential damages
• Our total liability to you for all claims shall not exceed the amount you paid us in the last 12 months
• You use our services at your own risk

7.3 Data Loss

• While we attempt to maintain backups, backups are not guaranteed and may be incomplete or unavailable
• You are strongly encouraged to maintain your own backups of all important data
• We are not responsible for recovering lost data

8. Service Modifications & Termination

8.1 Termination by RaspiHost

We reserve the right to suspend or terminate your account and services at any time, with or without cause, including but not limited to:

• Violation of these Terms
• Abuse of our services or infrastructure
• Non-payment of fees
• Extended inactivity (free plans)
• Operational or business reasons
• At our sole discretion

8.2 Termination by You

You may terminate your use of our services at any time by canceling your account.

8.3 Effect of Termination

• Upon termination, your access to services will be revoked
• Your data may be deleted immediately or after a brief grace period at our discretion
• No refunds will be provided except as required by law
• Sections of these Terms that by their nature should survive termination will remain in effect

9. Changes to Terms

• We may modify these Terms at any time
• Changes will be effective immediately upon posting to our website
• Continued use of our services after changes constitutes acceptance of the modified Terms
• We encourage you to review these Terms periodically
• For material changes affecting paid services, we will attempt to provide notice via email or Discord

10. Privacy & Data Protection

• We collect and process personal information as described in our Privacy Policy
• We do not sell your personal information to third parties
• We implement reasonable security measures to protect your data
• By using our services, you consent to our data practices as described

11. Intellectual Property

• RaspiHost, our logo, and any proprietary software we develop remain our property
• You retain ownership of content you upload to your servers
• You grant us a license to host and process your content as necessary to provide our services
• BeamMP and BeamNG.drive are trademarks of their respective owners and we are not affiliated with them

12. Indemnification

You agree to indemnify and hold harmless RaspiHost, its operators, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of our services
• Your violation of these Terms
• Your violation of any third-party rights
• Content you host on your servers

13. Dispute Resolution

• These Terms are governed by the laws of the State of California, USA
• Any disputes shall be resolved in the courts of California
• You agree to waive any right to a jury trial
• If any provision of these Terms is found unenforceable, the remaining provisions remain in effect

14. Miscellaneous

14.1 Entire Agreement
These Terms constitute the entire agreement between you and RaspiHost regarding our services.

14.2 No Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

14.3 Assignment
You may not assign or transfer these Terms without our written consent. We may assign these Terms at any time.

14.4 Transparency & Communication
RaspiHost is a small-scale project run by gaming enthusiasts. We value open communication:
